The cybersiege. A brief dogmatic study pursuant to article 480 of the Criminal Code of Puebla, Mexico

Abstract

This article examines the offense of cyber harassment under the current criminal provision, enacted through the legislative reform of 11 July 2025, which replaced the provision published on 13 June 2025, commonly referred to as the Gag Law. It analyzes the protected legal interests and the alternative criminalized conducts in light of both authentic and grammatical interpretation. The study argues that cyber harassment constitutes a result-based offense and examines its commission in the form of criminal attempt, as well as its intentional and negligent modalities. It also addresses the objective conditions of punishability and prosecution, the applicable penalties, and the statutory ground for exemption from criminal liability provided under the current criminal provision.
